Welcome to Moodpic.app. These Terms of Service (“Terms”) govern your access to and use of our mobile application (“App”) and our website (“Site”), provided by Ievgeniia Kobzeva (“we”, “us”, “our”). By using the App or Site, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App or Site.
We are located in the Czech Republic. These Terms have been drafted in accordance with European standards for digital services.
1. Agreement to Terms
By accessing and using the App or Site, you acknowledge that you have read, understood, and agree to abide by these Terms, as well as our Privacy Policy. If you do not agree to all of these Terms, you are expressly prohibited from using the App and Site.
2. Changes to Terms
We reserve the right to make changes or modifications to these Terms at any time. We will notify you of any changes by updating the “Effective Date”. Your continued use of the App or Site after the date of publication of the revised Terms will signify your acceptance of such changes.
3. App and Site Users
The App and Site are intended for users who have reached the age of 16. If you are a parent or guardian of a minor using the App or Site, you agree to be fully responsible for the online conduct of such minor.
4. Intellectual Property
Unless otherwise indicated, the App and Site, including all Content and Marks, are our property and are protected by copyright and trademark laws. A personal, non-transferable, non-exclusive, revocable license is granted to access and use the App/Site solely for your personal, non-commercial purposes.
5. User Representations
By using the App or Site, you represent and warrant that all registration information you provide will be true, accurate, current, and complete, and that your use will not violate any applicable laws or regulations.
6. User Content
You are solely responsible for all User Content you post on the App or Site. You grant us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, store, copy, modify, distribute, and display User Content for the purposes of operating and improving the App and Site.
7. Prohibited Activities
You may not use the App or Site to systematically extract data, make unauthorized use, circumvent security features, or interfere with the operation of the App or Site.
8. Third-Party Websites and Content
The App and Site may contain links to Third-Party Websites. We are not responsible for any Third-Party Websites or content. Your use of Third-Party Websites is at your own risk.
9. App and Site Management
We reserve the right to monitor the App and Site for violations of these Terms and to take appropriate action to protect our rights and property.
10. Privacy Policy
We care about data privacy and security. Please review our Privacy Policy. By using the App or Site, you agree to be bound by our Privacy Policy, which is incorporated into these Terms by reference.
11. Term and Termination
These Terms remain in full force and effect while you use the App or Site. We reserve the right to deny access to the App and Site to any person for any reason. If we terminate or suspend your account, you are prohibited from registering a new account.
12. Disclaimer of Warranties
The App and Site are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
13. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you for any indirect, consequential, or punitive damages arising from your use of the App and Site. Our liability will at all times be limited to 30 USD/EUR or the amount paid by you in the six months prior to the cause of action.
14. Indemnification
You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, or claim made by any third party due to or arising out of your use of the App and Site or breach of these Terms.
15. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the Czech Republic. Any dispute arising out of these Terms shall be resolved by the courts of the Czech Republic.
16. Special Terms for Apple App Store Users
These Terms are concluded between you and Ievgeniia Kobzeva (Moodpic.app), not with Apple Inc. Apple has no obligation to furnish maintenance, support, or warranty services with respect to the App. All claims relating to the App are our sole responsibility.
17. Miscellaneous
These Terms constitute the entire agreement between you and us. Our failure to enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
